1. Agreement to Terms

By accessing or using the website Bayo's Bobbles (the "Service"), a registered assumed name owned and operated by Tijani LLC (referred to as "We," "Us," or "Our"), You agree to be bound by these Terms of Service. If You disagree with any part of the terms, then You may not access the Service. These Terms apply to all visitors, users, and others who access or use the Service.

2. User Accounts

We reserve the right to change product pricing, descriptions, and availability at any time without notice.

Material and Visual Variation Disclaimer: Due to the unique nature of jewelry, especially pieces containing natural gemstones, metals, or unique craftsmanship, we cannot guarantee that the physical item will precisely match the images displayed. Natural gemstones may exhibit inherent variations in color, texture, and pattern. Furthermore, in compliance with industry standards, carat weight may vary by a tolerance of 0.05 carats, and gemstone measurements may have a tolerance of 0.25mm. You accept that these minor variations do not constitute a defect or failure to meet the product description. Any retail or comparative value listed for a product is an estimate and not an appraisal or guarantee of its current market value.
We reserve the right to refuse any order You place with Us. We may, in Our sole discretion, limit or cancel quantities purchased per person, per household, or per order.
In the event of a pricing error, We reserve the right to cancel any orders placed under the incorrect price, even after Your order has been confirmed and payment has been processed.

5. Payment, Shipping, and Returns

All purchases made through the Service are subject to this section.

Payment Processing: We use third-party payment processors, including PayPal, Stripe, and Google Pay, to handle financial transactions. We do not store sensitive payment information. All transactions are subject to the terms and policies of those payment processors.
Accuracy of Billing: You agree to provide current, complete, and accurate purchase and account information for all purchases made via the Service.
Shipping and Risk of Loss: Shipping and delivery estimates are governed by Our separate Shipping Policy. The risk of loss and title for all items purchased pass to You upon Our delivery to the carrier (e.g., USPS, UPS, FedEx) or upon delivery to the designated shipping address. We are not responsible for packages that are lost or stolen after they are confirmed as delivered to the address provided by You.

7. Jewelry Care and Safety

You acknowledge that jewelry may contain small parts that could present a choking hazard, and products are not intended for children under the age of 13. You are solely responsible for following proper care instructions. We are not liable for damage or injury caused by misuse, rough handling, or failure to follow recommended jewelry care guidelines.

8. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We make no representations or warranties of any kind, express or implied, as to the operation of the Service or the information, content, or materials included therein. You expressly agree that your use of the Service is at your sole risk.

9. Limitation of Liability

In no event shall Tijani LLC, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

Your access to or use of, or inability to access or use, the Service;
Any conduct or content of any third party on the Service;
Liability shall be limited to the amount You paid to the Company for the product or service.

Governing Law: These Terms shall be governed and construed in accordance with the laws of Texas without regard to its conflict of law provisions.
Dispute Resolution: Any dispute arising out of or relating to these Terms will be resolved through confidential binding arbitration in Austin, Texas, except that, to the extent You have violated or threatened to violate Our intellectual property rights, We may seek injunctive or other appropriate relief in any court.

We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. We will provide reasonable notice prior to any new terms taking effect. By continuing to access or use Our Service after those revisions become effective, You agree to be bound by the revised terms.
